Art. 653e a. Exercise of rights; capital contribution ⁽¹⁾

¹ The declaration on the exercise of the conversion or option rights shall refer to the provision of the articles of association concerning the contingent capital; where the law requires a prospectus, the declaration must refer to it. ⁽²⁾

² Money contributions must be deposited in a bank as defined in Article 1 paragraph 1 of the Banking Act of 8 November 1934 ⁽³⁾ for the exclusive use of the company. ⁽²⁾

³ The shareholder’s rights are established when the capital contribution is made.
