Art. 209 CPC from 2024
Art. 209 Authorisation to proceed
1 If no agreement is reached, the conciliation authority records this fact and grants authorisation to proceed:a. to the landlord in cases where a rent increase is challenged;b. to the plaintiff in all other cases.
2 The authorisation to proceed contains:a. the names and addresses of the parties and their representatives, if any;b. the plaintiff'"s prayers for relief, a description of the matter in dispute, and any counterclaim;c. the date of the initiation of the conciliation proceedings;d. the decision on the costs of the conciliation proceedings;e. the date of the authorisation to proceed;f. the seal of the conciliation authority.
3 The plaintiff is entitled to file the action in court within three months of authorisation to proceed being granted.
4 The deadline is 30 days in disputes over the tenancy and lease of residential and business property or the lease of agricultural property. (1)
