The Swiss Code of Obligations is a central code of Swiss civil law that regulates the legal relationships between private individuals. It includes five books that cover various aspects of contract law, law of obligations and property law, including the formation, content and termination of contracts, as well as liability for breach of contract and tort. The Code of Obligations is an important code of law for business and everyday life in Switzerland, as it forms the basis for many legal relationships and contracts and has been in force since 1912, whereby it is regularly adapted to social and economic developments.

Art. 999 Liability of the drawer

1 The drawer is liable for the acceptance and payment of the bill of exchange.

2 He may disclaim liability for acceptance; any comment whereby he disclaims liability for payment is deemed unwritten.

118 III 24Wechselbetreibung (Art. 178 SchKG; Art. 991 OR). Der Einwand, es fehle an einem Wechselprotest, führt zu einer materiellrechtlichen Frage, die vom Rechtsöffnungsrichter zu beurteilen ist. Der Betreibungsbeamte und in gleicher Weise die Aufsichtsbehörden über Schuldbetreibung und Konkurs haben demgegenüber nur zu prüfen, ob die eingereichte Forderungsurkunde alle wesentlichen Erfordernisse eines Wechsels erfüllt und eine wechselmässige Verpflichtung des Schuldners begründet.
