Art. 317 Forgery of a document by a public official ⁽¹⁾

1. Any public official or person acting in an official capacity who wilfully forges or falsifies a document or uses the genuine signature or handwriting of another to produce a false document,any public official or person acting in an official capacity who wilfully falsely certifies a fact of legal significance, and in particular falsely certifies the authenticity of a signature or handwriting or the accuracy of a copy,shall be liable to a custodial sentence not exceeding five years or to a monetary penalty.2. If the person concerned acts through negligence, the penalty is a fine.
