Art. 240 B. Personal capacity
1 A person with capacity to act may make gifts of his assets within the bounds imposed by matrimonial property law and inheritance law.
2 The assets of a person who lacks capacity to act may be used only to make customary occasional gifts. The liability of the legal representative is reserved. (1)
