Art. 209 Authorisation to proceed
1 If no agreement is reached, the conciliation authority records this fact and grants authorisation to proceed:a. to the landlord in cases where a rent increase is challenged;b. to the plaintiff in all other cases.
2 The authorisation to proceed contains:a. the names and addresses of the parties and their representatives, if any;b. the plaintiff's prayers for relief, a description of the matter in dispute, and any counterclaim;c. the date of the initiation of the conciliation proceedings;d. the decision on the costs of the conciliation proceedings;e. the date of the authorisation to proceed;f. the seal of the conciliation authority.
3 The plaintiff is entitled to file the action in court within three months of authorisation to proceed being granted.
4 The deadline is 30 days in disputes over the tenancy and lease of residential and business property or the lease of agricultural property. Other statutory or judicial filing deadlines are reserved.
