Summary:A Somali national who has been living in Switzerland since 1998 applied for the extension of his residence permit. Due to his criminal record and his dependence on social assistance, he was denied the permit and was to be sent away from Switzerland. After a recourse, it was decided that the man should be admitted on a temporary basis, but the procedural costs were imposed on him. He filed a complaint in order to cancel the refusal of the permit and receive compensation. The Administrative Court partially dismissed the appeal and granted him the free administration of justice. It was found that the refusal of the permit was justified due to his criminal record and dependence on social assistance, and deportation to Somalia is currently inadmissible. The costs of the proceedings were divided up, and the unpaid legal counsel received appropriate compensation.
