| Summary: | The case is about an insurance claim due to an accident at work, in which the insured suffered an injury to the right knee. After various medical treatments and examinations, it was found that from December 1, 2016, the insured was able to fully exercise his activity as a team leader. The insurance company refused to grant a disability pension due to the fact that the insured was able to carry out his usual activity. The insured filed an objection and claimed a disability pension. The insurance company rejected the appeal, after which the insured brought the case to the Social Insurance Court. The court ruled that the insured was able to carry out his usual activity, and therefore there was no economic damage that would justify the right to a disability pension. It was found that the insured person could have earned an income of CHF 84,042 without disability and CHF79,840 with disability. Thus, the right to a disability pension was rejected. |
