| Summary: | Summary of the judgment of the Federal Insurance Court of 10 March 2020 (I 55/2019)
On November 4, 2016, a glazier fell out of a window and seriously injured himself.
The Accident Insurance Institution (UVG) refused to recognize the accident as a professional accident.
The glazier, on the other hand, filed a complaint with the Swiss Federal Insurance Court (ECG).
The ECG proved the glazier right and recognized the accident as an occupational accident.
The UVG must pay the glazier a disability pension.
More details:
The glazier was working on a scaffold as part of his professional activity when he fell out of a window and suffered a traumatic brain injury.
The UVG justified its refusal by the fact that the glazier had fallen not during work, but during the break.
However, the ECG came to the conclusion that the accident was based on a connection between the professional activity and the fall. The glazier had been on the scaffold during the break to stow his tools, and therefore had not yet begun his leisure time.
